Tool 03 · Utah need-to-knows

Things every Utah buyer should know.

Plain-language facts, with sources. These aren't sales talking points.

Utah is a non-disclosure state

Final sale prices aren't public record in Utah, so online “estimates” work from limited data and can be noticeably off. MLS sold comps give you the real picture before you offer.

About 1 in 3 Utah homes test high for radon

Utah DEQ reports roughly a third of homes tested are above the EPA action level of 4 pCi/L. Test during due diligence. If levels are high, mitigation systems are common and usually straightforward.

Some Utah soils move

Collapsible soils (common on young alluvial fans near mountain fronts) and expansive clays can damage foundations when they get wet. That's why I care so much about grading and drainage.

Utah uses a state-approved purchase contract

Most Utah home purchases use the state-approved Real Estate Purchase Contract (REPC). Its key protections run on dates you negotiate, not fixed day counts, so those dates deserve real attention.

Your contract in plain language

The four dates that protect you.

  1. Seller Disclosure Deadline

The seller delivers their disclosures about the property's condition, plus HOA and other documents. Read every page. I'll help you spot what needs a follow-up question.

  2. Due Diligence Deadline

Your window for inspections, radon testing, sewer scope, insurance quotes, HOA review, and anything else that matters to you. This is where my walkthrough notes become specific inspection requests.

  3. Financing & Appraisal Deadline

Your loan approval and appraisal need to come together by this date. We'll stay in close contact with your lender so nothing sneaks up on you.

  4. Settlement Deadline

Final documents are signed and funds are delivered. Then it's a walkthrough, a recording, and keys in your hand. 🔑

This is an educational overview, not legal advice. Exact rights, including what happens to earnest money if you cancel, depend on the current state-approved form and your specific contract. Ask me or a Utah real estate attorney about your situation.
